Holding
The Court held that schools may determine eligibility for women and girls sports based on biological sex, reasoning that the term sex in Title IX cannot plausibly be interpreted to refer to anything other than biological sex and that West Virginia has permissibly maintained female sports for biological females consistent with Title IX. The holding aligns with Article III equal and merit-based protection of women athletes and with Article XIV education administration, and its textualist reading of the statute aligns with Article XVII. No Automatic Fail. Final 84 — America First.
It is the judgment of this Court that Opinion No. 2026-0628 is hereby entered into the record, in accordance with the America First Constitutional Standard. The score stands. The reasoning is published. The record is public.
