This is the third worker-protection enforcement release in the record, and the gravest: it follows a worker fatality. An employee asphyxiated while inspecting a tanker trailer, and the Department cited the employer with 16 serious and three other-than-serious safety violations, including failure to implement a confined space program, proposing $264,380 in penalties. It is scored consistently with its two siblings (0737 and 0738), because the constitutional character is the same — the government enforcing the law to protect the American worker and holding a violator to account after a preventable death. That is the most direct vindication of Law, Order, and the Safety of the Citizen, the article whose subject is exactly this (XVIII); it defends the American worker from a lethal, preventable hazard (II); and it rests, like its siblings, on federal safety regulation that a limited-government reading treats with some caution but which here enforces existing law rather than expanding it (IX, mixed). The Standard notes the underlying harm is graver than the hospitalization in the prior citation, but the constitutional alignment of the enforcement is the same: the Standard scores whether the government is doing its rule-of-law duty to protect the citizen, not the severity of the tragedy that prompted it — to let severity move the score would be to score the news rather than the canon.
