The United States, having declared neutrality in the war between Spain and her colonies, treats each side as a belligerent and may not interfere without becoming a party to the conflict; the political branches, not the courts, set the terms on which armed vessels and their prizes are admitted to U.S. ports; and a vessel that illegally augmented its force within U.S. ports in violation of American neutrality must restore the property it captured on that cruise.
