The Court declined to extend Bivens to create an implied damages remedy for a cross-border shooting: because such a claim arises in a new context with foreign-relations and national-security implications, and because creating damages remedies is a legislative function committed to Congress under the separation of powers, the Judiciary will not imply a Bivens action against a Border Patrol agent who shot and killed a Mexican national across the border.
