Holding
The Department of Commerce's antidumping duty order, following affirmative less-than-fair-value and material-injury determinations, enforces U.S. trade law against injurious dumping of Korean monomers and oligomers and protects an American industry. The ITC found 'an industry in the United States is materially injured...by reason of imports,' and margins run from 65.72 percent to 155.42 percent (facts available with adverse inferences). The order places American producers and the rule of fair trade above foreign commercial advantage. No Automatic Fail. Default 70/30 weighting applied (agency enforcement action with factual determinations assessed). Strongly America First.
It is the judgment of this Court that Opinion No. 2026-0924 is hereby entered into the record, in accordance with the America First Constitutional Standard. The score stands. The reasoning is published. The record is public.
